上海去年职业索赔投诉量高达24.6万件，近8000人年投诉量超过10件。还有人在一年内以“无证拍黄瓜”为由向1372家餐饮店提出高额索赔。

4月28日下午，上海市消费者权益保护委员会与上海市消费者权益保护基金会联合举办了第二期“提振消费维护权益”大讲堂。活动邀请了人大代表、政府部门代表、企业代表以及专家学者等各方人士，共同就“职业索赔现象对消费信心与营商环境的影响”这一议题进行深入讨论。

近8000人年投诉量超过10件

在大讲堂上，原上海市市场监管局一级巡视员胡浩代表上海市消费者权益保护委员会课题组，分享了关于职业索赔问题的最新研究成果。他指出，近年来，职业索赔案件的数量呈现出持续上升的趋势。根据相关统计数据显示，2023年上海市职业类索赔类投诉数量达到了惊人的24.6万件，其中年投诉量超过10件的投诉者有近8000人，而且这一现象呈现出团伙化、链条化的趋势。这些职业索赔行为主要集中在表面合规性问题上，并已经开始从日常消费领域向劳务用工、金融税收以及个人信息保护等领域蔓延。为了应对这一问题，胡浩提出了七点建议，包括区分牟利性索赔与一般消费维权行为、分类分级适用惩罚性赔偿以避免“小错大赔”、全链条落实过罚相当原则以切实防范“小过重罚”、完善举报奖励机制、压实经营者主体责任、推动社会组织发挥更大作用，以及利用数智技术加快建立跨部门共享的投诉举报异常名录等。

接着，上海市市场监管局消费者权益保护处处长谢正豪详细介绍了市场监管部门受理的职业索赔类投诉举报的相关数据分析结果。数据显示，举报中排名前两位的问题分别是广告违法行为（占34.79%）和不正当竞争行为（占31.11%）。其中，广告违法行为主要集中在虚假广告方面，而不正当竞争行为则主要集中在虚假宣传上，尤其是使用绝对化用语的情况占据了相当大的比重。这两个问题都主要出现在产品的介绍说明、产品的标识标签以及产品的包装文字上。此外，他还透露了一些典型的职业索赔案例，例如刘某在一年内以“无证拍黄瓜”为由向1372家餐饮店提出高额索赔等。

许多合规瑕疵并非企业故意为之

为了更深入地探讨职业索赔现象的影响和解决方案，大讲堂还组织了两场圆桌讨论。

在第一场讨论中，沃尔玛、联华超市、永辉超市、新雅食品和饿了么等知名企业的代表纷纷分享了各自遇到的相关案例以及职业索赔行为给企业正常经营带来的困扰。

在第二场讨论中，市人大代表许玮提出了针对性立法的建议以遏制职业索赔现象；市司法局二级巡视员李平则就如何落实《消费者权益保护法实施条例》以规范职业索赔行为提出了具体建议；上海市民营经济协会副会长兼秘书长刘楷表示，职业索赔现象对民营企业的营商信心影响很大，他呼吁建立有效机制遏制职业索赔行为，保护民营企业的合法权益。

最后，上海市消费者权益保护委员会强调指出提振消费信心与优化营商环境对于经济发展的重要性。虽然我国的法律法规标准体系日益完善并为消费者权益提供了强有力的法律后盾，但同时也给企业特别是小微企业带来了一定的合规挑战。许多合规上的小瑕疵并非企业故意为之，也不会对消费者造成误导或对产品质量或食品安全带来实质性影响。然而大量职业索赔者却利用这些合规瑕疵通过投诉举报来牟取私利，这给经济和社会发展带来了不利影响。具体来说这些影响包括损害营商信心、影响市场活力、抬高营商成本和消费成本进而影响消费者信心以及违背商业诚信、败坏社会风气等。
